Everyone is so anti-mers, and calls these big bank’s crooks, etc. Leaving aside arguments involving county recorder fees on subsequent transfers (the original note and mortgage are recorded), how has anyone actually been negatively affected by MERS? Did MERS come to your house and prevent you from making a payment to your mortgage servicer? Did MERS make people lose there job whereas they couldn’t earn a living sufficient enough to make a mortgage payment?
I’m not trying to start a huge fight, so no need in calling me the devil here. I’m just trying to figure out how MERS has ever negatively impacted a single american in a manner that caused them to lose their home?

State law allows the clerks to keep one-tenth of 1 percent of each foreclosure sales price as personal income. If you actually read #2 in the document she filed is states “Defendants have also conspired to deprive the Circuit Clerk of fees lawfully due them. However, there are many Circuit Clerks who will not accept the foreclosure money, instead putting it back into the Courthouse budget, etc. So, please don’t think she is going after these Big Companies to help our County. She is just part of a whole slew of Circuit Clerk’s who are wanting money for themselves and she is using our taxpayer dollars to fight these companies to get it. A Circuit Clerk is an elected official with a renewalable 2 year term. She is up for re-election and won last time because she had no opponent. I hope someone runs against her this time. The deadline to file is March 1st, 2012….I think.

I called Citi, and got through to a guy named Shawn Lyerly, and he laughed when I asked if he was a Vice President. He informed me that he was a notary. However, in the following documents, he is a Vice President:

It’s been a while since I reviewed my docs…it was a RELEASE OF MORTGAGE FROM MERS…that had Shaun Lyerly’s scribble signature on it…with an out of state notarization of course which would make that release of mortgage invalid…… no doubt….

Does anyone have any idea why Recon trust stopped all foreclosures in the state of arkansas? They even took the past sales of foreclosed properties for arkansas off of their website.
