Medina said Bakersfield police officers came to the home, but they couldn’t kick the family out. “Unless we can prove that the proclaimed renter knew that the situation was fraudulent from the very beginning, our hands are tied. It’s a civil situation,” said Sgt. Mary DeGeare, Bakersfield Police Department.

Renters/squatters have rights. The squatters can produce a fake rental agreement and make up a fake Realtor. The police will see the false agreement and will determine at the time that it is a civil matter. The squatter that knows this will wait for a summons and answer the summons for less than a 1000.00 to start. They will ask for a continuance, delay the appearance, answer with denial of proper service etc.. you get the idea. Then they will submit to the court that they have 2 or 3 other renters their and each of them will file a false BK, one at a time delaying the Eviction giving the squatters about a year of free rent. Bad situation for the homeowner. Protection under the law sometimes protects the wrong people.

This is going to get uglier and uglier..I am noticing more and more empty homes in my neighborhood….that creates a breeding ground for crime. ..all of the empty homes are useless…this homeowner sure seemed calm..I am not sure most people would react so calmly…and why aren’t the police doing their jobs?…..wouldn’t this be considered a home invasion?
Cops are SOL because of recent ruling of Calvo v. HSBC – they can’t check county records to see who beneficiary is in event of disputes.
Tresspassing is a civil matter? Since when?

Why can’t this homeowner go to the police department and get a copy of the report? The report will show who the Realtor is on the rental contract….duh! That Realtor should have his/her license revoked and a complaint made against the state authority who regulates Realtors!
