I’m stuck in a payment plan with Regions for 113 years! I just re-did the math and its longer than I even thought. They would release the mortgage but not the note for my short sale to go through. They required me to sign on a payment plan until I’m 156 years old at $350.00 per month in order to release the mortgage. This was not a deficency judgement through the court but a contract they made me sign on the side. This plan does not even address deficency agreements that are required by the bank where they don’t go through the court. What will be accomplished by limiting deficency judgements to 2 years? NOTHING The banks will just require private agreements that don’t go before the judge. No deficency judgement just a private contract! I have a complaint at the CFPB but Regions won’t prove they owned the loan even when they made me sign this agreement now.
Kimberley…..are you doing a short sale or a refi? Or they want you to sell the house and pay 350 a month for 100+years? If so, why would you agree to that contract and sell your home..?
I did a short sale. Regions released the mortgage but there was a remaining balance that was left. Regions would not write this off and they told me sign this agreement for the remaining balance and we will release the mortgage. In stead for going through the court and asking for a deficency judgement for the allowed 5 years after the short sale as this is not even necessary. Regions made me sign on a payment plan fot 113 years for the balance before they would allow a short sale to go through. This story really gets a lot worse I didn’t tell the entire story. The reason that I had to sign this agreement under duress is because JP Morgan my first position loan used Florida Default Law Group to file the foreclosure agaist me and I showed the judge that they didn’t own the loan on two occasions with there own filing and she didn’t care. I could not figure out who to bankrupt as I paid off someone that didn’t own the loan. 2 years later I still can’t file bankruptcy. JP Morgans fake assignment went from WaMu to JPM when and employee at JPM told me Fannie Mae owed my loan so why wasn’t the fake assignment from Fannie to JPM? They can’t even get there fake documents straight! The above people are so clueless as to what is really going on. They are about to remove the requirement for proof in court which can only lead to an increase in mortgage fraud. They are about to reduce deficency judgements from 5 years to two years. The banks are going to laugh, and require an agreement like the one I had to sign before the short sale can move forward. They can make it for any length of time and don’t need to go before the judge and don’t need a judgement. I have contacted every government agency that applys about my loans for helps and not one agency has even bothered to call me and ask a question. Nobody could identify the problems easier than the people that have lived the problems. Obviously, they have not even done a flow chart off all problems and solutions before jumping to these deplorable laws. I would be happy to post the letter that I had to sign if someone will email me how to do it. Florida deserves better. I would love to file bankruptcy but I don’t know who owned my first position loan for real and if they have been paid off. In other words you have to know whom to bankrupt in order to file and if your chain of title has been destroyed how do you figure this out? Will the real owner or owners please stand up! Original notes and mortgages need to be taken away at the closing table/ scaned and put into a linked “recording” government land record system. The original documents should never be touched by the banks after the closing. If Florida wants to do something helpful shut down MERS an illegal side system set up by the banks don’t remove proof from the courts, protect proof!
I ‘m wondering what the Florida Supreme Court will have to say about these laws. Or any reasonable honest judge for that matter.

A lot of Snowbirds are going to lose their homes. Since they can’t vote in FL, they have no recourse. It’s going to be very hard to locate neighbors who live abroad or travel in the reduced 90 day period.
More forec losure devastation for Florida communities. Seasonal tenants will probably bury the banks’ notices on their coffee tables instead of forwarding to the owners, allowing hte banks to say they couldn’t find the owners,.

Google their names..find out where they live and protest outside of their homes too!….this stinks like a dictatorship…an illegal and Uncocstitutional tyranny!
