David Dayen’s Keynote Address about Chain of Title to the National Consumer Law Center
In the depths of the Great Recession, a cancer nurse, a car dealership worker, and an insurance fraud specialist helped uncover the largest consumer crime in American history—a scandal that implicated dozens of major executives on Wall Street. They called it foreclosure fraud: millions of families were kicked out of their homes based on false evidence by mortgage companies that had no legal right to foreclose.

I am looking for a Fraud Expert. Long story as with everyone, but , having paid cash free and clear for my Retirement Home, I rejected and never affirmed a loan liened on my home.No Consideration vi-a-vis this homeowner. Countrywide/BOA funded the loan to spouse telling me “We cannot stop it “. Tried Rescind, still ignored. Anyway, I won in Civil 2014 with prejudice. Just what C/BOA wanted as then they misrepresented on Appeal and “were given all favor on differences in facts and inferences”. The judge’s order was vacated and I was left with embarrassing bank misrepresentations trailing my incredibly hard-working civically-minded family.
The bank had strategized to lose on the Lower Court’s Motion for Summary Judgment. Why? So their Appellate brief might humiliate me by publishing an erroneously fraught story of deadbeat abused me, my bought and paid for home , which they said had been bought with a mortgage, and the deadbeat family. The publication only inflamed me to speak out quietly for the rest of my life against this Oligarchy of Banks who’ve hijacked our
American Property Records. We need to get the word out that our country is being taken over by anyone who’ll buy a piece of the paper purportedly securing our homes which Wall Street has stolen and sold. I’m not giving up. I have the Free and Clear Warranty Deed and Property Title in my strongbox.
The only good person in this case was an honest Honorable Mello who saw what was happening at the Foreclosure Firm and called a spade a spade. He was rotated out and I now have to essentially reprove my whole case again. They’ve given me 1400+ pages of discovery (after waiting into the fourth year for it).
I doubt they have the “original note” to support their contested foreclosure, and suppose they’ll manufacture one in response to a Motion 34 request. Can anyone direct me to a “forensics/fraud” expert such as Lyn Szymoniak to render an opinion or find indication that the note has been manufactured? I am not on the note anyway and received nothing from it, but it is deemed to have a claim on my home.I ‘d be thrilled to have any tips as to what I ought look for when I view what I anticipate to be a manufactured document?I I have an accounting background and know a little but have zero training in fraud. I want to start a grassroots support group for survivors of banking fraud as well. There’s no such thing in Vermont, the bucolic idealistic Bernie state. No such thing as a fraud survivors group, I meant, but, now that I think of my case and having read many others in this state, I think white collar crime does not exist in this state as well. I am a life-long hardworking person, Sunday School&Substitute Teacher, Artist and former auditor (not fraud but I can recall enough). Americans have a major land crisis here. I hope this packaging/securing/ publicly selling of notes on our properties is outlawed as there is no one with whom to lodge complaint. The Lender only misrepresented to my Attorney General’s office-I do have an email catching this misrepresentation though.A person’s protest and rejection did not matter in my case–no lender is the “owner” for that. Does anyone know how to contact someone like Ms. Szymoniak? I also would like to know if anyone has dealt with the irreverent foreclosure law firm in Rhode Island of Schectman, Halperin and Savage? After eight years rejecting, rescinding, protesting, I’m resigned to fighting for the rest of my life what the banks have done to our country–please reply to this post if anyone knows anything about spotting fraudulent document, Thanks Caroline
It should be noted that the entities who can be defined as FAKE LENDERS ,” NEVER ” created a lien on the property !!!! It was all accounting fraud !!! A LIE !!!! Therefore they had no right of transfer !!!! The Mortgages , are the fraud !!!!! The Homeowners were totally unaware of the swindle that was going down and that the Investment Banking system was involved in the illegal scheme !!! John Kasich was a CEO at Lehman Brothers at the time , and the political sector didn’t know what was going on ?????? Really ?????
