Missouri Court Enjoins Bank and Law Firm From Evicting Family

After foreclosure and entry of a Judgment in Unlawful Detainer, a Missouri court enjoined a bank and its law from taking any further steps to evict a family of 7 from their home. The family did not seek legal counsel until after the foreclosure and judgment was entered, and with only 48 hours remaining before they were ordered to leave their home. Argument was made that because MERS had attempted to transfer the note but had no authority to do so, the foreclosure was a nullity. A separate suit for wrongful foreclosure was filed, and a claim for breach of fiduciary duty was asserted against the law firm. The injunction states that the bank and law firm are enjoined until “final adjudication” of the separate suit.
