Bank of America Sets Foreclosure Sale on Home with NO Mortgage

Wrongful home foreclosures rare not so rare – but devastating

Kamal Sharma almost lost his house in a foreclosure auction the other day. The funny thing is: He doesn’t even owe any money on it.

Sharma’s story – an extreme case even in Sacramento’s chaotic real estate market – shows that lenders continue to make foreclosure mistakes despite extensive publicity and promises to fix problems, which include sloppy paperwork and communication breakdowns.

“There are a lot of people that have been wrongly foreclosed upon,” said Kevin Stein, associate director of the San Francisco-based California Reinvestment Coalition.

Sharma’s troubles started last month when he arrived at his West Sacramento house one day to find a foreclosure notice from the servicing arm of Bank of America taped to the front door.

Sharma, 34, had paid $85,000 in cash for the three-bedroom home in March, using money from a settlement he received from a workplace accident in which he lost half of his left foot. He planned to rent the house out for income.

Listen, Countrywide and Bank of Destroying The American Dream might have already been paid back by several for loans from unidentified investors, multiple times, and by credit default swaps and insurance. It is a potential insurance fraud! Then they want the homeowner to pay them again! The simple fact is that our loans might have been concurrently sold into multiple Trusts at the same time, which would be equivalent to selling the same car over and over to several different people using a COPY of the pink slip or Title of the car. IT IS ILLEAGAL!

    Nevertheless, If there is a break in the chain of title: “An obligor is not obliged to pay the instrument if the person seeking enforcement of the instrument does not have rights of a holder in due course and the obligor proves that the instrument is a lost or stolen instrument.” – U.C.C. provision, U.C.C. §3-305(c)

      Piggybankblog…of course they got paid…..they sold the loan before you even signed your name…that is why it is called a fraudulent inducement….they are trying to collect on an ULTR VIRES contract….in order to collect the seals insurance money….that is why it is called foreclosures fraud…..the frsud started the day they sold the loan on to wall street and they hog paid….exponentially….this is fraud on steroids as many have already stated!

    Funny, Bank of America tried the same act against me in a similar way trying to foreclose on me with a mortgage in the name of MERS. And another one had no mortgage, but one was improperly filed, which is a crime by the criminal banks – not a mistake or a civil issue.

    Get this. HUD is approving reverse mortgage foreclosures based on the information provided by the lender. HUD is not verifying the truth of the lender statements putting thousands of vulnerable seniors at risk of losing their home on the word of lender’s who lie for their own benefit.

He did some really good things for the people of the State of Illinois and that is why he got it. Like some news anchor said, corruption is a part of politics. They are all corrupt.     Too Big To Fail is TOO BIG TO FUNCTION! OK, so THIS lender realizes they shouldn’t have foreclosed after it was PROVED to them, but what if the previously foreclosed loan had multiple investors, or was sold into several different investment trusts (VERY COMMON), and a DIFFERENT investor wasn’t paid off in the previous foreclosure?!?! Title policies of late are EXCLUDING coverage that would protect an REO buyer. Check it out!! So it is possible that the originators of a loan can sell it several times over to several different investors, which may each have the ability to foreclose (since nobody seems to actually have the physical note anyhow, and therefore they get the courts to allow them to create a new note for the “lost note”. Then the other investors can foreclose again? but the new Buyer is not protected with Title Insurance, because the Title Companies already KNOW that there may be multiple mortgage investors and they are clever enough to protect themselves against paying off the new homeowner. If all loans and mortgage assignments had to be recorded at the courthouse, so title companies and owners could verify the status of their debt/ownership condition, this could not happen. But then came MERS….

      The title co’s were in on the fraud. The home builders were in on the fraud. The real estate co’s were in on the fraud. Look at what you have in your possession. Look at all of your closing papers and your DEED to your home. Look at your public recordings and your title. I have uncovered so much fraud in my entire loan by EVERYONE involved. FROM BEFORE ORIGINATION TO THE FRAUDCLOSURE, THE FRAUD IS RAMPANT. ANY FRAUD IN A CONTRACT KILLS THE CONTRACT. They were all invested in the mortgage fraud. One palm, greased the other palm. The problem for the multiple mortgage investors is they got sold an empty bag of shit. THE ONLY SECURITY WAS THE MONEY FLOW. THAT WAS IT. THE PERPS NEVER SECURED THEIR COLLATERAL LIENS. EVER. OUR HOMES ARE PAID FOR FREE AND CLEAR BECAUSE OF THE PONZI SCHEME. GOD BLESS AMERICA.

      • YES….go over the closing papers many times..what you miss the first few times will suddenly ‘ pop out ‘…if you never received all the documents at closing….call and ask for them from the title co…if they refuse…than subpoena them for all documents….Generally the title co. records the mortgage in county records and will request the recorded mortgage to be returned to title co. The title co. sends the recorded mortgage to the creditor, who had wired the money to the title co. I am told that you request all information of the creditor…..the address they sent the recorded mortgage to. and so on in your subpoena..
        When I was making a comment on my daughters mortgage /foreclosure…and went to summit it…for a split second over the part of the title co…..the words ‘ criminal intent ‘ appeared. If I had blinked I would never have seen it…BUT I DID. I knew the door was opening to show me something…..I looked up legal criminal intent and knew right away that what I had ‘ felt ‘ all along was infact true. I had felt the Mortgage Broker, the Bank and the Title Co….were all in the fraud….to hide the actual creditor/lender/funder. So don’t give up…..just keep digging….But as the saying goes….follow the money…….I am not a lawyer and what I know is what I found on my own and alot of hours. But the final decision is…MAKE THE FORECLOSING BANK PROVE WITH THE ORIGINAL NOTE AND MORTGAGE THAT THEY ARE THE ACTUAL OWNERS…JUST BEWARE OF FRAUD IN THE ‘ COPIES ‘ OF THESE DOCUMENTS. I read an article an expert wrote that said….’ Just don’t ask to see the original note…ask for both the original note and original mortgage….the note by itself may mean it is an unsecured note….without the mortgage.’ .

        Great advice, Marilyn! The mortgage is where they killed their own contract in my case. Because of that ORIGINATION FRAUD, even if they have the original note is worthless junk.

      My title policy is an owner’s policy and says it protects me as long as I own my title. Some of the covered risks are:

      1.)Someone else owns an interest in your title.

      2.) A document is not properly signed, sealed, acknowledged, or delivered.

      3.) Forgery, fraud, duress, incompetency, incapacity or impersonation.

      4.)DEFECTIVE RECORDING OF ANY DOCUMENT.

      8.) THERE ARE LIENS ON YOUR TITLE, ARISING NOW OR LATER, FOR LABOR AND MATERIAL FURNISHED BEFORE THE POLICY DATE-UNLESS YOU AGREED TO PAY FOR THE LABOR AND MATERIAL.

      11.) YOUR TITLE IS UNMARKETABLE, WHICH ALLOWS ANOTHER PERSON TO REFUSE TO PERFORM A CONTRACT TO PURCHASE, TO LEASE OR TO MAKE A MORTGAGE LOAN.

    They are doing these thngs on purpose. I just found the “Note” manufactured out of a loan modification request, which by the way was turned down. WOW, they didn’t even do a good job of it. Maybe thats why the Recorder of Deeds wouldn’t record it. What I do have is a Quit Claim Deed from Countrywide to my husband and myself and thats it, so now I will write a letter to BOA and demand to see a Deed of Trust. We’ll see where that goes. So far they have ignored my verbal requests. Love to all. PS, go to the Recorders Office and get your papers!!!!!!

        Until the actual creditor comes forth…..and chances are they won’t…..these mortgages are paid….paid by the creditor…a creditor who does not have a signed contract by the borrower….the ‘ pretender lender ‘ the bank owes this loan to the creditor….and the borrower does not owe any money to the strawman sitting at the closing table. So the creditor has no signed contract by the borrower …nothing…..cause the bank borrowed the money…..and the contract does not mention the borrowers….this is where the origination fraud come in…..fraud also to the ‘ investor’ as the figures given to the creditor are greatly increased according to the fraud appraisals. So the amount the bank borrowed from the crediot was at least double or higher than the original mortgage of the homeowner/borrower. This fraud was done knowing the bad loans would be in foreclosure in just a few years. So they stuck it to the creditor/lender deliberately and figured the borrower was to dumb to figure out fraud.     Try this for BOA documentation filling
    My MHA Original documents was submitted in January 2010, then in November 2010 I was told that they needed more information regarding residence of my home. I submitted this information in January 2011. I was told they had received the new information and would be reviewed and included in the application from February to May 2011, I was receiving from BOA letters stating that my application was still being accelerated. On the 26 June 2011, I received a letter stating that my application for a MHA Modification was unsuccessful.

    On the 28 June 2011, I rang BOA and spoke to Tariaria, in the MHA dept:( I think that this was her name but the phone line was so poor I could not hear clearly) she said that other people complain but there was nothing she could do about it. She told me that as my original application was for M.HA loan was incomplete at the time of review my application as is, was incomplete and canceled. BOA then transferred my application to a BOA modification loan application. Because there cannot be two loan applications at the same time. When BOA received my amended documentations in January 2011 the information was (quote) “the appeal was filed incorrectly” not applied to the MHA documents that had already been submitted. BOA had acknowledged that it was received. The MHA application was accelerated in January 2011, but as the information I sent was never applied to the MHA file, resulted in my MHA application yet again being declined.

    After spending nearly an hour on the phone, she told me that she would transfer me to the BOA traditional loan modification: she put me on hold then the phone went dead.!!!!!!!!

      People who are buying homes need to be educated in the true facts of modifications of mortgages. Unless you
      are corresponding DIRECTLY with YOUR real lender you are wasting your time, efforts, and money. The servicers cannot lower anyones’ mortgage papers without the direct authority of the lender. It doesn’t matter what kind soft ware programming the federal government dreams up they cannot keep the borrower from going
      into foreclosure if the real lender does not directly intercede.
      Modification is a shell game in the biggest fraud of all, land grabbing.

      Send the “lender” the RESPA QUALIFIED wheres the note letter. Go to wheresthenote.com Compare what they send you to your closing docs. The letter asks the “lender” for a copy of the PSA agreement and proof of their ownership of your loan. See what they send you. Why would you want a loan mod unless they prove to you they own your loan? BOA is no doubt just a servicer for FANNIE or FREDDIE and they don’t own your loan. I would ask for full disclosure before agreeing to or signing anything.

    America, the patient, is very weak and gravely Ill, to the extent she now requires intensive care. While she lay dying on the operating table it is becoming painfully apparent that the environment in the operating room is septic. There are those who wish to see her survive and there are those who do not. In this medical metaphor, we are the surgeons, our understanding of how to treat the patient and the tools we use are not scalpels and sutures. The tools we use are laws and our ability to articulate them.

    We have an epidemic on our hands. A plague. While the specific individual steps required to cure each patient may differ from the next, the pathogen is the same. Just as it would be irresponsible of a Chief Medical Officer at a hospital to realize a deadly plague exists, and to deny to all his surgeons their need to be aware of it – so it would be if a judge were to deny the fact we are suffering from a financial plague brought about by widespread deliberate indifference to the Law. Confining each individual case to the issues in the instant matter without considering that millions are succumbing to this plague, in increasing numbers, creates an impediment in the quest to find a cure.

    Those that do not wish to see the patients survive either the financial plague or my imaginary medical plague are at every crack and crevice of the operating room, relentlessly and remorselessly pumping pathogens towards the patients in an effort to further add to the sepsis. The surgery still needs to be performed individually – but it must be acknowledged that the waiting room is full of new patients.

        vs.

        America, Inc. [Defendants]

        The Plaintiff’s could adequately plead the necessary elements of fraudulent representation in order to defeat a Motion to Dismiss.

        Defendant’s would offer no valid case law to support their position because there is none.

        The court would rule in favor of the Defendant’s based on economics as opposed to the Law.

        I know Kudlow is for the rich and I am not a fan but I do agree with him on the tax revolt. I knew he was going to rip Obama for wanting to tax the rich. We need a tax revolt.     Lender’s everywhere feel entitled to what hardworking American’s have worked for all their lives, Is this a surprise? I also received a forclosure notice from Financial Freedom who has been harassing me since 2009 on a reverse mortgage fraudulently sold to my parents in 2005. Although I have been communicating and providing documented proof we are in compliance I was ignored and my documentation was ignored. This week I got the default and foreclosure notice with intent to sell the property. Who is going to protect the innocent victims of predatory lenders and when will it stop?

We got a 67% tax increase and these corrupt bastards still are not paying the bills? Everyone should just stop paying everything,, period. BTW, Bloomberg reporting today that Timothy Geithner, may be resigning after the debt ceiling issues are solved. He shouldn’t wait till then, he should have been gone along time ago for aiding and abetting the criminals who robbed us…

      5.) The oupouring of My Grace will raise the sinners up.
      6.) The Churches will be overflowing with penitents.
      7.) The pain and confusion will be at its maximum.
      8.) The priests will have to hear confessions around the clock.
      9.)There will be no “life as usual”
      10.) Businesses will be closed.
      11.)People will finally understand the meaning of charity.
      12.) It will be up to the strong to take care of the weak.

    The article didn’t address ‘the rest of the story’. The prior owner still is in title. Mr. Sharma must do a quiet title to get the prior loan and owner off the title. The problem did not just go away because the bank pulled the f/c.
    The prior owner must sign over right, title, and interest. Who will file a Satisfaction on the prior loan? Who knows who ‘owns’ the debt…does anybody really know. This is far from over for the new owner. Welcome to Wonderland Mr. Sharma.
