$49,825 didn’t satisfy lender

Homeowner emptied bank account for her house, but it wasn’t enough to stop Chase from foreclosing.

When Mardee Jerde’s bank threatened to foreclose on her house if she didn’t immediately make up nearly $50,000 in overdue mortgage payments last year, she paid up — even though it left her virtually penniless.

Two days after J.P. Morgan Chase acknowledged receipt of Jerde’s $49,825 money order, however, the bank told her she didn’t qualify for the one thing that would have made it possible for Jerde to remain in her home in Rush City, Minn.: a permanent loan modification.

Jerde said she feels betrayed by the banking giant. She said she did everything demanded by Chase, including making partial mortgage payments for 11 months after a car accident left her unable to work. To satisfy the bank, she wound up using the entire settlement she won from her lawsuit over the crash.

“If I had known that [the bank would foreclose anyway], I never would have sent that money,” said Jerde, 68. “I would have been out of my mind. That was given to me to live on. Now I have nothing.”

But after being contacted by Whistleblower, bank spokeswoman Christine Holevas said Chase will try to intercede on her behalf. Without the bank’s help, Jerde could be forced from her home as soon as Aug. 23.

“I will try and find a solution,” Holevas said last week. “I can’t promise that I will. I can reach out to some folks.”

Let’s make sure Ms Holevas intercedes here and makes this right…

    Let me say that if you going to lose your house, then why not just take all you can from the house and run. You are going to have ruined credit anyway. If you take the valuables with you, then you have something to live on by selling the dishwasher, outside air conditioner, etc. This may teach banks that they should not fuck with the average consumer. I would never throw money at the bank who is foreclosing on me. At the point you realize you are going to lose your home, then take and run, baby. You will leave the bank with having to replenish everything to sell and who cares if your credit is ruined – it is already ruined. Seriously, you think that the bank is going to return your credit to sterling silver status? Think not. Grab and run, baby. That’s what will teach the banks to stop raping the average home owner. Rape them before they rape you.

    i called Christine Holevas i spoke with her directly , she quickly stoped me and said ” sir , dont beleive everything you hear , the case is much more complicated than what the public made it appear in the news and papers, and yes we are trying to work with the home owner for a solution to his problem”.

  3. this sounds too familiar, payments on 2nd for over 1 yr, declined any assistance, demand went from 20,000 to 30,000 night prior to 6,000? had already fallen for the 1200, 3000, used all iras then ssdi payment to cover mortgages, illegal loss of one home most recent home purchased for 620,000 with 20%down, payments 12 yrs on one 5 o the other, $50,000 is a big number I was so sorry that I didn;t have the $30,000 to save my home? they would have done the same to me, modification done on one property, promised too assist with perfect payments for 2 yrs, gave them 3 yrs, injured again, refused any assistance, late payment they already included attorney fees, this was federal housing/ and we thought it was just the banks, hear the latest let investors buy and rent back to homeowner? /homeowner clearly loses, at 64 with far too many falls and broken bones glad I won’t be around much longer feel worried about the children & their children, CAN NOT BELIEVE THE FEDERAL GOVERNMENT, ATTORNEY GENERALS AND STATE GOVERNMENTS ARE UNABLE TO STOP THIS! So far they just crawl in bed and the cities take revenue for blight! ANOTHER WASTE OF FUNDS! Wish Gov.Brown of California had time to deal with these crooks the state is destroyed! I am sorry if none of this makes sense anymore unable to defend or help

      hey ruth and tracie i have also been in my own hell here in florida. asked wells fargo for help in 2009 due to a job loss and it has been down hill since. maxed out credit cards to stay in my house. meant nothing to wells fargo during hamp application. i will \
      write it all quick lost paper work, moved files, changed pointed of contact, appraisal fraud, origination fraud. i wrote OCC, florida AG, local congress man. all they did was foward what i wrote to wells fargo. all i received in response was more loes, written at least so i can present them to the judge and i will pray to god that my 25 years as an RN will ring some ethical feelings in the judges sole. bought for 260k in 2006 with 20% down. homes selling in tampa bay area of florida 62-100. counties and cities going bankrupt. food prices so high. no jobs. i do not know how the restaurants make it around here i guess people must be living on borrowed money like i did for a year. so i am as distraught as you. i have 3 kids and a husband and we are losing our home. i will fight hard. i have no money for a lawyer and the only lawyer is my cousin in jacksonville whom does not want my case but i do not have a choice. dont think i could go pro se. i am so sad. only + thing with jobloss i got a scholarship to the local ymca. i will go do zumba and yoga and when i lose my home i will cry and most likley end up in jail because i will scream and be in contempt of court.

      [yes if it i did notmeet all of you i would have been long gone from my house renting somewhere. i would have been a sheeple. i am not know what is happening i know the fraud and i will fight. please along with discovery of the note we must be asking who funded the mortgage. we need all to find the true lender of our mortgage. if the true lender is not lostedon the note,mortgage there was not contract. null and void and the note would not matter. to much in court about the psa, the note, and assignmrnts. that means one thing people are still sleeping do not know the truth. so please help us all out as some of us wait for court. ask fo rthe loan originator remember if the lender is not on the mortgage it is null and void.

    This is a prime example of the ramport foreclosure fraud that is taking place in this country. The nation should wake up to this dramatic shift of wealth throught any means (fraud by the super elite) and creating a subclass in America and instant rental society. This action is shameful but no one cares unless it effect them directly very sad.
    There maybe help in the future through legal means, however the FDIC position as the director stated on 60 minutes the problems is large and the solution is to have homeowners that are wronged by the banksters to sign affidavits not to sue. What a great solution the banks get a huge bailed out again, home owners go to the rental ads seeking shelter. When will we stand up for something and stop falling for the drama.

      Given the extended rescission rights under TILA and the high probability of a rescindable violation under state and federal UDAP, she should be advised to contact an experienced consumer/bankruptcy attorney in her jurisdiction. Remember, there is no longer a 3 year limitation in a defensive situation and rescission wipes out the right to interest (effectively reducing the face value of the note by about 10% for each year payments were made) , and, if she rescinds and tenders at the same time (requesting a payoff for refinancing) at the time she rescinds, all time periods run side-by-side, probably wiping out the duty to pay any further under the note and still entitling her to recover all paymen ts made (including the $50,000).

    I just call and spoke to Jean and left a message for Christine that as a concerned citizen and support of Mardee Jerde’s that Christine will do what she can to help Mardee Jerde to keep her home. Who wants to move at 68. No one, and especially when being duped into emptying ones bank account and still get the shaft. These banks must be stopped and as soon as we find a way, I am all for it. I lost a rental property to deceptive foreclosure and still wanting to fight it but the tenants were able to stay (glad for that). Just trying to find some help.

      Dont waste your time or effort talking to BANKSTERS instead hire yourself a lawyer you trust or know, if the BANKSTERS call you dont take the call they are not suppose to contact you if an attorney represents you and they know that but are DESPERATE, step on their toe’s real hard break them if you have to but don’t give in!!!

      Don’t do short sales either they allow the banksters an easy way out of their fraud, benefits the new buyer with a great low price @ your expense + the bankster will use IRS form 1099 for the deficiency after the short sale is completed this is not a big deal though as it will probably create a WASH ask your accountant for the cost basis of your home. The banksters may also go after the deficiency from you if they feel you can pay even though you cant and that will force you into BANKRUPTCY.

        IT is Chase’s own legal counsel that are part of the problem. The Rouge Trustee Services and the lawfirms that own these sister companys, not to mention their own title company. They cannot even insure the very titles they are foreclosing on. What does that tell you? They do not act independenlty. This is a free for all… non-party of interests looking to get THE FREE HO– USE, but they will try and turn that argument that it is the homeowner trying to get the free house. Do your homework, that is all I can say. Everyone is wanting a piece of the homeowner’s pie. This was all created by the Greedy Blood Suckers Scum of the Earth. They will get theirs in the end. I wonder what percentage that negotiator got when they talked Mardee Jerde into releasing those funds? Probably a $2-$3K commission for realing in such a payment. I feel for Mardee, as she did not know what corrupt evil was about to embark upon her.

    Unless this bank has the authority from the true lender to modify this loan in any way, the promise
    is just that, a promise. If the bank agrees to subsidize the payments, by lowering her payments
    and making partial payments with bank money the modification can go through. NO investor is
    going to take a hair cut because someone had a wreck, can’t work and can’t repay the money.

    My mortgage is serviced by Chase for Deutsche Bank, NA… Chase has planed this game with us to the tune of an unsubstantiated 20,000 dollars that started out in 2008 with a triple overage charge for escrow and then all of a sudden we were late and charges have accrued for over 3 years. I went into my local branch every week for however many hours to make all the phone calls and to get them to make the phone calls since they do not want a scene by a customer in a little local branch, for other customers to hear the disatisfaction. I told the Asst Branch Mgr that if I had to waste many hours of many weeks of my time then someone at Chase had to waste their time. The person helping me got a hand typed half way qualifying printout of my account for two years and it was not even correct with no justification of erroneous amounts that were shown. I am still fighting their errors and have consulted an attorney, sent all documentation of many other issues also to my State’s Attorney General’s Office. They have three pending file for my mortgage, also send a letter to the Better Business Bureau, go to the Help Line Places, and also if your mortgage is in a trust check the filing with the SEC. Most were not filed properly therefore the bank(s) do not own the Deed and Title. Verify all this in your County Clerk or Recorders office. Most will be happy to help as the filing fees for all these changes should have gone to each County for all the lack of recording due the the “MONSTER” MERS. GOODLUCK with the “Evil Empires” allowed to run-a-muck!

    First mistake was trusting JPMChase…. Virtually ALL WAMU loans were “sold” by WAMU about the time you inked your closing paperwork. If WAMU SOLD the loans, how can JPMChase still “OWN” the loans? As “successor in interest”…?

    Hire a qualified attorney first and foremost.
