    I’m curious here. Everyone is so anti-mers, and calls these big bank’s crooks, etc. Leaving aside arguments involving county recorder fees on subsequent transfers (the original note and mortgage are recorded), how has anyone actually been negatively affected by MERS? Did MERS come to your house and prevent you from making a payment to your mortgage servicer? Did MERS make people lose there job whereas they couldn’t earn a living sufficient enough to make a mortgage payment?

    I’m not trying to start a huge fight, so no need in calling me the devil here. I’m just trying to figure out how MERS has ever negatively impacted a single american in a manner that caused them to lose their home?

    Mamye Brown did this for her own personal gain. Do not let this confuse you! The circuit clerk is entitled to 1% of all foreclosures. State law allows the clerks to keep one-tenth of 1 percent of each foreclosure sales price as personal income. Look up……for more information. If you actually read #2 in the document she filed is states “Defendants have also conspired to deprive the Circuit Clerk of fees lawfully due them. There are some Circuit Clerks making over $100,000 a year off of other people’s pain. I do not know how much she has made and I wonder if she will tell you. This is all outside of her regular pay. However, there are many Circuit Clerks who will not accept the foreclosure money, instead putting it back into the Courthouse budget, etc. So, please don’t think she is going after these Big Companies to help our County. She is just part of a whole slew of Circuit Clerk’s who are wanting money for themselves and she is using our taxpayer dollars to fight these companies to get it. A Circuit Clerk is an elected official with a renewalable 2 year term. She is up for re-election and won last time because she had no opponent. I hope someone runs against her this time. The deadline to file is March 1st, 2012….I think.

      Arkansas Recorder of Deeds are so toxic. It wasn’t for her personal gain. Apparently, you have not read about 2007-2009 financial crisis where they bundled thousand of mortgages into one and sold them on wall street, leaving the notes and mortgages gone or destroyed. The individuals who finally pay it off will never have a clear title, because investors have purchased a piece of the pie. Do you research please. Been there, done that!

    Shawn Lyerly is most likely a pseudonym used by MERS, Citibank Trust Bank, FSB, Citibank, N.A. and most likely more companies.

    I called Citi, and got through to a guy named Shawn Lyerly, and he laughed when I asked if he was a Vice President. He informed me that he was a notary. However, in the following documents, he is a Vice President:

    He is probably an employee of the trust company, and his phone number was a Maryland area code; so he’s probably in Gaithersburg.

    Here he signs as a notary:

    I was foreclosed on by CitiMortgage, Inc., though my note was with ABN AMRO Mortgage, Inc., and no assignment was done at the county level. However, when the Reconveyance Deed was signed, it was signed by this Shawn Lyerly as the “Vice President” of Citicorp Trust Bank, FSB, and NOT as a VP of MERS, as the last link above demonstrates he was.

    Any thoughts on what I should do?

      Too funny Adam!!!!…Shaun Lyerly was a notary for the MERS assigment of mortgage that I picked up from the County Recorders Office….The stamps on the notary page of that assignment are a joke…they are stamps of womens dresses on hangers!!!

        It’s been a while since I reviewed my docs…it was a RELEASE OF MORTGAGE FROM MERS…that had Shaun Lyerly’s scribble signature on it…with an out of state notarization of course which would make that release of mortgage invalid…… no doubt….

        There was no signature..I got the scribble signature off of google in order to verify if this was a real notary.,..

    Whoa there is some seriously bad ass shit in there. Especially the parts about failing to record assignments to non-MERS members and falsely designating itself as beneficiary of the mortgage.

      indioo7..Let’s hope so..they should have been toast a long time ago…MERS apparently sold my loan to CITI….I never got a loan from CITI…never made a payment to CITI, was never informed CITI owned my loan…Until I went to the Recorders Office and discovered CHICAGO TITLE AND TRUST recorded a RECORD OF PAYMENT in 2007 right after we refied with AMCORE BANK, WHO NOW CALLS THEMSELVES AMCORE NA MERS AND IS ALSO A FAILED BANK……THE RECORD OF PAYMENT FROM CT&T WAS TO TO CITI for $ 290,000 and a RECORD OF PAYMENT on a $20,000 loan to In Bank that we paid off in 04….it was not a mortgage….but they put it in MERS obviously without my knowledge..then CHICAGO TITLE AND TRUST recorded a release to PUBLIC who were apparently CITI and IN BANK..NO RELEASE OF MORTGAGE WAS RECORDED BY CITI OR BY IN BANK…AT THE RECORDER OF DEEDS OFFICE…..there is only a release of Mortgage recorded by MERS to my husband and I…Notarized by a SHAWN LYERLY WITH NO NOTARY STAMP AND NO SIGNATURE..THIS WAS RECORDED AT MY RECORDERS OFFICE…AND A WITNESS OF THE UNDERSIGNED INSTRUMENT APPARENTLY by THE VP OF MERS…MARILYN C. BROWN… WHO DID NOT SIGN IT EITHER…. Tons of fraud and deception….

    Monkey see , monkey do – as my Dad would’ve said . Contact your county treasurers office , put a bug in there ear , in my county it is better to go to the office in person. Lay a line on them , we all have a little con man in us , me I am blessed w/ a whole lotta BS in my line , be manipulative . When they hit the calculator total button , they will drop a jaw . All we need to do is let them go at it , my county NEEDS the money and I am in Md . Your County ? How are your roads ? Bridges ? This is a double edged sword , it will also prove that any MERS loan is BS and falls under Federal Law as a stock , not a tangible ,secured asset . As they would like us to believe – Good Luck All

    Does anyone have any idea why Recon trust stopped all foreclosures in the state of arkansas? They even took the past sales of foreclosed properties for arkansas off of their website.

Al of us should be suing these crooks out of existance…I found an interesting Letter to the IRS… at Foreclosure Pro Se. com…..Time to make the criminals pay the piper…
