This bill is introduced by the same Florida Senator, Michael Bennett, who introduced the 2009 Non-Judicial Fraudclosure Bill that he had the nerve to call the Florida Consumer Protection and Homeowner Credit Rehabilitation Act (more on that here and more ….

For now, Republican Senator Mike Bennett has had to put the bill on hold, because the banks argue the bill is too consumer-friendly.

With eight days left in the legislative session, Bennett says he’s in negotiations to get the bill back on track.

“Obviously, the banks are looking to cut down the amount of loss that they possibly can,” Bennett said. “They don’t want me to make it too easy to protect the consumer.”

Well………he’s baaaaack…This bill could be called the “Fraudclosure Debt Collectors Take Over Local Citizen Supported Law Enforcement Bill.”

SB 970: Foreclosure Proceedings

GENERAL BILL by Bennett

Foreclosure Proceedings; Citing this act as the “Florida Property Preservation Act”; authorizing a financial institution or lender that institutes a foreclosure action to file a motion requesting that the circuit court issue a certificate of abandonment and preservation of property; requiring that the sheriff or deputy sheriff conduct an inspection of the property to determine if it appears to be abandoned; requiring that the sheriff or deputy sheriff post a notice on the property if it appears to be abandoned; authorizing the financial institution or lender instituting the mortgage foreclosure proceeding to perform certain actions in order to preserve the property, etc.
