Promissory Note Fraud | Bondi Capitulates, Admits Promissory Note Transfers Invalidated by Fraud

It’s right there in black and white Folks (page 2 document below). Maybe a lawyer could pipe up to let us know if this strikes at the heart of negotiability of promissory notes, invalidating them?

In a concise motion submitted by Bondi herself to Florida’s Fourth District Court of Appeals, Bondi became the nation’s first law enforcement officer to concede that not only are fraudclosure assignments of mortgage fraudulent and invalid, but so are the promissory notes’ assignments (meaning endorsements and allonges).

Many foreclosure proceedings have been marred by the use of invalid assignments of notes and mortgages, often by “robo signing.”

WOW! What a change of heart!

Never in a million years would I have predicted Pam Bondi would lead the pack by laying out the promissory note fraud, which invalidates the notes as negotiable instruments.

    We make such a big deal when Blondi in Florida does anything positive for the people, as it is so shocking. Lets put in perspective, Kamala Harris, California Attorney General is suing Fannie, Freddie and all the rest. Blondi, what about LPS, FDLG, MERS Provest etc. The list is too long. The FBI has said Florida is ranked the worst in Mortgage Fraud. What are you doing? What progress has Florida made?

    From what I’ve read – In April 2011, a FL judge ruled that the AG couldn’t continue its investigation of certain fraudclosure law firms under the civil unfair trade practices rule(s). This action (thanks judge) ended the AG’s office investigations of Stern and the other similar slime. The judge took the position that the actions didn’t relate to trade or commerce (uh, buying a house isn’t — and the actions taken to assume that property aren’t?) …BUT the judge indicated the AG’s office could pursue a criminal (vs. civil) if certain other criteria was satisfied.

    Now, it would seem to a non-attorney layperson that these attorneys did violate criminal law so unsure why the AG didn’t proceed and seems to just want to go after them via civil law (oh yeah, most lawyers [accept the honest, decent ones] won’t go after other lawyers…and surely civil violations are less serious than criminal — and settlements can be made (again, letting ’em off the hook) with the AG.

    So, it seems to me that the AG’s (oh yeah, this was written by someone other than Bondi) office seeks a easier route to pursue civil infractions that would involve $$ settlements vs. pursuing criminal investigations. But, that’s just my thought at a first blush review of this doc.

      Angry: I agree 100% with you! Bondi is Bondi. This request will do nothing for the homeowners who are fighting for their homes. This will only give the criminals a “get out of jail free” card. Bondi’s New Year’s resolution,going from helping the criminals to protecting the people is commendable but will never happen. If she makes only one criminal charge against an executive of these TBTF entities and their legal eagles I may change my mind. Until then I will continue to rail against the foreclosure/eviction fraud happening daily to us.

    Maybe Ms. Bondi redeemed her soul with God and before it is too late, she decided to do a good deed before she goes in from of St. Peters. Or maybe she is following orders of the Masters Banksters to create a sense of trust and then give the people of Florida a KABOOM! Now, what we will say if David J. Stern himself, if he would do the same as Bondi? I guess we will be up for a hell of ride, won’t we?
    Although this is a great step in the right direction, we are not out of the woods yet. Now we still need to educate the judge and all the judges under the payroll of the banksters in one way or another to follow the black letter law.
    Amazing country where the law already exist and had been written for over hundreds of years and still we need to prove ourselves in the courts. Who would ever imagine that an attorney takes the oath of the constitution and is allowed by the court to commit perjury in filing false documents, assignments, transfers, affidavits, and promisory notes, none of them being originals and having not knowledge what they are or what they even means. I would love to question most of the banks’ attorneys about property law. I read and hear all the time that the banksters’ attorneys don’t even know how to file a complain and they even forget to enlist the cause of actions. I wonder how they got their license in first place.
    We need thousands of judges like Judge Shack out of New York. This is the hero of America for many years to come. This is our role model and many judges should learn from Judge Shack and apply the law when it needs be applied regardless who are the parties in the case.
    Or perhaps, Ms. Bondi is coming up for election and she wants to get the trust of the people of Florida to vote for her again. Anything is possible in this crisis. As the politicians said, why let any opportunity goes to waste.

    What a great start to the New Year. Who cares how she got there- if she is attempting to do the right thing, there’s time later to bash her for the past- she appears to be publicly exploring legal reality and that is a very, very good thing for Florida…FINALLY! It’s been a judicial spectacle in Florida, very hard to watch the ongoing angst and frustration of those fighting a corrupt system. HAPPY NEW YEAR!

    Happy New Year to everyone–hope the next year will be better for us all than the last 3.

    Ditto, Richard, our family is in bpndage to Chase, hoping it isn’t a cold winter as we’ll be under several layers of blankets, sweators and coats, including my 91-yr-old mother-in-law who lives with us. The pantry is bare.
    Our 19 – year- old car still manages to get us around town.

    A big thank you to the Palm Beach Post, for steadily kept the pressure on Pam. Yesterday’s (Friday’s) editorial read like a summary of points made on this site. It urged her to do her job for her constituents, the homeowners, and prosecute fraudulent banks as other states’ AGs do. It mentioned her staff being too close to LCS and her letting go of 2 effective prosecutors who were doing their jobs. It cited her excuse for sticking with the 50 state settlement process on the grounds that if she didn’t, “homeowners would do strategic defaults, letting their homes slide into foreclosure.” (!!) The editorial concluded that it wasn’t her job to be second guessing what homeowners would or wouldn’t do in the future, but to be a prosecutor now.

    Wells Fargo Home Mortgage the drug felon has me held captive on a home mortgage that is under water. I want to stop paying so I can eat properly and heat my house this winter and drive my car for doctor appointments but paying Wells Fargo will not let me do that. I am a handicapper also.
