New York AG cancels bank settlement statement
WASHINGTON – New York Attorney General Eric Schneiderman late Tuesday postponed a much anticipated conference call with reporters that was set up to announce whether the state would participate in broad a settlement with five big banks over foreclosure practices. Schneiderman, who is co-chair of a new mortgage fraud task force, told reporters in late January that he was not ready to participate in state settlement negotiations. Observers had speculated that he might announce his participation. The state of New York announced Friday that it was suing Bank of America Corp. BAC +0.13% , Wells Fargo & Co. WFC +0.20% , and J.P. Morgan Chase & Co. JPM +0.05% , claiming they used an electronic mortgage database to submit false and misleading information in courts making it appear the bank had the authority to bring a case when it may not have.

Anyone have Schneiderman’s email address or website?
We need to make an inquiry. I am particularly interested in discrediting MERS. This is the key to resolution and change in foreclosure activity. If MERS is illegal, it might be chaos but you would see the industry on their knees trying to resolve these loans.
In fact, as an appraiser, I am seeing mountains of short sale refis and short sale purchases. The big guys are seeing the handwriting on the wall and dumping these mortgages into the hopper to resolve the problem. Of course it is bigger than life itself so I don’t see how they can cover their stuff but they are showing effort. Expect there to be something in the AG works to alleviate MERS discredit efforts.

Supposedly, one of the tenets of the multi-state agreement maintains the integrity of AG Schneiderman’s suit against MERS—–they tried to foreclose on me in 2009—-here’s hoping they go down hard. A little RICO goes a long way………

A YEAR ago when I made my own report to Schneiderman’s office, I did get that somewhat generic response but I also got follow-up mail that showed that SOMEONE had indeed requested information from the servicer.
I find it VERY interesting that the suit filed last week EXACTLY aligns with the allegations that fit my own case. MERS was used to attempt to act as the nominee of a corporation that did not even exist. Phantom corporations can’t authorize MERS to act as a nominee.
Definitely, the responses you get from the AG may seem generic but they DO pay attention to the reported information.
