Florida House passes foreclosure act
The Florida Fair Foreclosure Act, which aims to streamline foreclosures, passed the state House of Representatives today by a vote of 94-17.
Rep. Kathleen Passidomo, R-Naples, first introduced the bill and the measure, HB 213, took on several co-sponsors before reaching the House floor.
“What I do want to say is I wrestled for this with this issue for months, for years,” Passidomo told legislators just before the vote. The bill ended up extremely narrow in focus and “will do some great good for the State of Florida,” she said.

We’re all aware of the foreclosure crisis facing our state, and I have co-sponsored 2 pieces of legislation that hope to address this important issue by expediting the foreclosure process. HB 213 by Rep. Passidomo will accomplish the following:
· Reduces the statute of limitations for deficiency judgments on a foreclosure action from five years to one year
· Amends the expedited foreclosure process to allow all lienholders to use the procedures, instead of just the mortgagee; reduces the number of hearings from 2 to 1; and prohibits service by publication when using the expedited process unless the property is abandoned.
· Requires the plaintiff in a foreclosure action to provide information to the court upon filing of the case regarding lost, destroyed or stolen promissory notes.
I support HB 213 by Rep. Passidomo because I do believe that banks are largely responsible for the foreclosure process, but they are not the only ones at fault. For that reason, I have also co-sponsored HB 319 by Rep. Moraitis. Florida is one of only a few states that requires banks to pay a portion of past due HOA assessments, known as “Safe Harbor”. HB 319 simply clarifies the current statute, providing that banks must pay 1% of the original mortgage value or 12 months in fee assessments. This clarification is necessary because some law firms are attempting to tack on additional fees to the lenders, beyond what is required by law, resulting in a delay of the resale of property.
Some constituents have perceived HB 319 as another “bank bailout” and have sent correspondence to that effect. The provisions of HB 319 are not intended to protect the banks, nor does it propose to increase or decrease the current assessment fee rates, but rather clarify what is already law.
At the request of CAN (Community Action Network), HB 319 also clarifies that third party purchasers at aunction must pay all assessment fees, interest, late fees, and legal fees.

From what I have read. This bill is not yet LAW. Its still needs to go to the Senate. What concerns me is their has been so much support from our politicians especially the REPUBLICAN NEOCONS that it feels like its going to be a done deal. Everyone needs to file a bankruptcy and let a federal judge ask them for the note and proper assignment. Thats when they back down. Also bankruptcy judges will always give you the right to mediation.
So that quick summary judgment wont happen. I know bankruptcy is expensive and a lot folks are busy paying their foreclosure attorneys and some even pro se, but we need to be prepared to make these Neocons and Banksters show proper cause. Also the law would go retroactive. How this will affect the foreclosures already in the pipe line is a guess at best. It could even stall them. Once you are in litigation and you filed your answer and defenses the ball is rolling.

Here is a copy of the letter that I sent today to my district rep. who voted yes on this bill. I encourage all Floridians to follow suit and not just one time but constant reminders to our elected officials that this cannot and will not be tolerated.

I am a resident of Ormond Beach and I am very concerned with the passing of HB 213 and your yes vote on that bill. For the past few years I have been researching documents filed in Volusia County Courts pertaining to foreclosures and in the course of that research I have discovered a large amount of what I will call improprieties which questions the validity of the documents. During this time I have met with several County officials including a meeting with Liz Whitaker the RMLO for the clerks office along with their general council. While reviewing and discussing the documents Ms. Whitaker and council told me that they were aware of some of the defects in the documents but they could not do anything about it due to a lack of authority. Since then I attended a County Council meeting at which I asked to speak in an attempt to find out who has the authority to address these issues and was told someone would get back with me. After waiting a month and a half with no response even after several e-mails I attended another County Council meeting at which I was told were sorry but there is nothing we can do. Now we are passing a bill which will expedite the foreclosure process without even knowing fully the damage that has already been done to our land records let alone what speeding the process up will do. It is my belief that you owe it to the people of your district to at least look into the problem that already exists and the potential problems that this bill will create. To expedite foreclosure is merely kicking the can down the road which eventually will lead us to a much bigger issue.

I’m sorry for you guys in FL and we all know how hard you worked to have it defeated. Things just have to turn in our favor as the “stink” from this huge “stinking” scheme continues to be exposed piece by piece. We will all stay strong; continue to fight and pray for God to keep us strong. There is power in pray so keep putting them out there to this wide universe.
AMEN! What has been hidden is coming to light. Pandora is out of the box and they can’t undo what has already and is continuing to be exposed. Sad what is going on in Florida. Prayer does work and this is so unjust. We have to continue to pray, fight, expose, write-we can’t be passive. This is the biggest crime in history-it is criminal and needs to be prosecuted as criminal. I have a direct line with DOJ CA and they are responding.
sam, we have to have faith and I know that it is hard but try and believe that God has a plan..! Funny, as I just typed those words…my light fixture on my wall…blinked on and off a few times..and it still is…God said that there would be signs for his true believers…!! Dont stop believing…!!
I have also seen proof in the power of group prayer and faith first hand…My grandfather was near death after his second open heart surgery and the outlook was grim…my Grandmothers sister in Seattle started a prayer chain and we all kept believing he would recover…and he did…and for years my Grandfathers open heart surgeon called him a miracle man and he lived for another 27 years after that….!! We just have to try really hard to have faith and dont stop believing….!
What is worse than me fighting 2 fraudclosures..? Trying to talk my 23 year old son out of joining the Marines right now…he is running out of hope…but I have to keep the faith that he will change his mind…and I am going to pray really hard..!
Wow! Our 2nd mediation is Friday, March 02, 2012 in Pensacola, Florida. Have been disputing Citi since 2005. Lots of money gone, still can lose our home of 18 years………….this is a very SAD day for us folks in Florida. !st Mediation in Feb. 2012, Citi did not provide one peice of documentation we requested aka……payoff, what are you charging us for, appraisal, assignment of mortgage…….they totally disregarded the law. They gave us 12 working days to provide info all the way back to 2008 and during the holidays. I am too numb to think right now. But I will post outcome of mediation……good or bad. God Bless us all.
Ok Folks, I stated I would update the status of our mediation on Friday, March 03, 2012. This was our second mediation and has been scheduled for a 3rd. CitiMortgage was not ready for us again. They did not provide NO requested docementation. But to make us feel better, they were going to run the numbers in the system to see if we qualify for the HAMP Modification. Mediation was to start at 12 Noon. It did not start until 12:50pm. The mediator left our notes on his dresser at his house so he was not prepared nor updated with the status of our claim. After 2 hours of nothing (even Citi attorney did not know anything about our case and left mediation to get a McDonalds hamburger). So Citi is plugging in numbers????????? What Numbers???????? Could these be the same numbers we have been requesting (like for payoff and all other charges)? Well Folks, Citi stated they had a problem and could not get us qualified and that our payment would be much higher. Well, I ASK……….WHAT NUMBERS ARE YOU PLUGGING IN? Response from Citi (now Citi had all the information since the 17th of Feb) $62,049.00 for original balance (we have been paying for 18 years), $29,000.00 for arrearages and additional funds for attorney and penalties. What a joke! It cost us over a $1,000.00 for this day. Scheduling the 3rd mediation, the mediator wanted to know if we were willing to pay his $350.00 for the day. We said NO but of course Citi was proud to pay. And during the scheduling of the 3rd mediation, the mediator ask if he could schedule our appointment on a day that he would have another mediation. Well he ended up with 3 cases on the same day. I am glad someone got some good out of it. It was totally stupid and a waste of time. Again, my husband lost his overtime for the week. These folks need to get it together. I will post out come of 3rd mediation. I just dont see any justice for us at all.
