Of course the banks knew they were defrauding people, paying loan originators and mortgage brokers high dollar to ‘boost’ the type of loan product you received. The higher dollar yield the more was paid under the table or in commission to the brokers and originators who ‘sold’ the loan. This was the crime that so many fail to see and think people were just deadbeats on liar loans. Not so, Many of us had good credit scores and could have qualified for better loan terms but we were ‘sold out’ by our friendly mortgage broker. Often these terms were switeched at the closing table and people had a choice to walk out or accept the ‘deal’ offerred. Many did not know enough to walk out.
It makes me angry to think how many people were sold on the ARM when it was not necessary.
But the public has been brainwashed on the idea that the homeowner bought too much house on a liar loan and therefore deserves to be foreclosed on if default occurs.
In the case above, the court rightly denied the servicer standing because they did not ‘own’ the note and mortage at the time proceedings began. This is mere technicalities and does not address the fraudulent practices the banks engaged in or bogus documentation. It was a safe call on the part of the court.
One part of the problem, the major part is that the servicer and the fed, insurance and investment industry participated in a process that erased the incomes and credit itegrity that was used to qualify us for the loans in the first place. There is no statement made in the mortgage that speaks to if lender parties to the agreement cause mortgagor to suffer loss and there should be. We didn’t cause the melt down – they caused it. I was looking at article 9 of the constitution that seems to have language that is usable however all parties to an agreement are supposed to be equal to the intent of that agreement. That is not what is happening now. I even added an addendum to my loan closing that Wells Fargo Mortgage and its assigns is not to be the loan servicer. I have had problems with WFB since 1984 and with WFM since pre 2005. I have contacted lawyers and have decided to go that route. Going “perse” seems like a faster way for now as I am past 60 with them and have to understand that all of these people have a paycheck to protect. Some of them even take my objections personally…how funny is that? Gotta love them anyways or the toxicity will poison me beyond where I am at now.

Don’t trust insurance companies, don’t trust title companies, real estate agents/brokers, appraisal agents, inspection agents, or any of the other entities involved in the buying and selling of the real estate market. If at possible, save up cash, and buy on a personal basis from an individual with the assistance of a good lawyer.

in some cases never will have a clear title because of the improper use/abuse or negligence of not filing each

Those who bought and sold these questionable properties knew this before putting them back on the market. They have been selling hot or

how can htese people sleep at night knowing they stole our home equity. and then they want the whole house becuase they accepted fraudulent appraials from appraisers they strong armed to come with the high appraisal to begin with. all of this is so nasty to comprehend every link in the chain is distgusting yet every day our courts continue to allow the scam to continue. most of the foreclosures left are the 30 yr fixed with 20% down. we are the folks whom have held on and are asking our servicers to work with us. we are 25-65. we were taught to own a home so we can use the mortgage interest deduction. we studdied the great depression in school in high school and college. we learned about the FDIC. we learned about buying a house if you use the mortgage interest deduction you can itemize. while on our 1st or 2nd jobs we learned about 401k plans. so we have been learning our whole live how to do the right thing. we were taught to buy a starter home and then when you out grown that house sell and buy up. so me and my husband did everything we were suppose to do. we bought our 1st home in 1991 small but perfect for us. we moved to a larger home in 2004 now with 3 kids in tow. we put our 20% down on the new home. we bought from GL homes a reputable builder in the area. we truste dour loves to them. the 1st signs of trouble camin sept 2005 i got a broward county tax bill of 7k (former tax bill in starter home 1500). remember we approved for this house but i never got a 7k raise in 1 year, the builder had told us taxes were going to 4k. the next sign was home owners insurance was 4k, (starter home insurance 800$). i new something was wrong and then sh-t the fan my husband lost his job. we were able to sell and move. takin our equity and buying newhome 300 miles north where property taxes would not devistate us. we put our 20% down again. the crash 2001 caused everyone we new to lose money in the 401 k plans and we didnt want the money in the bank so we would have easy access. we wanted our equity in our home so when the time came we could take out a home equity loan and help our kids with college. the time is here my 18 yr old son is graduating from high school. he is not going to start at state university 25% student loans are in default. he will stay home and start at community college. so basically the equity that was stolen from us is costing my son his education, why must americans endure this pain of losing our equity and our houses. where is our help why are they punishing us for doing the right thing . it doesnt make sense that if i would have put no money and left my money in the bank i would still have my money today and my house. we need help we need to keep our house or have our equity returned to us.. this is high crimes and needs to be investigated.

i hope you get my post @deboss thank you for getting it. yes the appraisals were scams . what can we do to wake people up. we can not be paying these mortgages they were alllf allsified. straw buyers. one court they are foreclosing the next court they are charging 13 people with mortgage fraud straw buying, flipping homes and not paying for the homes. its was rampant here in th tampa bay area yet they continue to foreclose on peolpe. dont know what to do. its making me sick
how can htese people sleep at night knowing they stole our home equity. and then they want the whole house becuase they accepted fraudulent appraials from appraisers they strong armed to come with the high appraisal to begin with. all of this is so nasty to comprehend every link in the chain is distgusting yet every day our courts continue to allow the scam to continue. most of the foreclosures left are the 30 yr fixed with 20% down. we are the folks whom have held on and are asking our servicers to work with us. we are 25-65. we were taught to own a home so we can use the mortgage interest deduction. we studdied the great depression in school in high school and college. we learned about the FDIC. we learned about buying a house if you use the mortgage interest deduction you can itemize. while on our 1st or 2nd jobs we learned about 401k plans. so we have been learning our whole live how to do the right thing. we were taught to buy a starter home and then when you out grown that house sell and buy up. so me and my husband did everything we were suppose to do. we bought our 1st home in 1991 small but perfect for us. we moved to a larger home in 2004 now with 3 kids in tow. we put our 20% down on the new home. we bought from GL homes a reputable builder in the area. we truste dour loves to them. the 1st signs of trouble camin sept 2005 i got a broward county tax bill of 7k (former tax bill in starter home 1500). remember we approved for this house but i never got a 7k raise in 1 year, the builder had told us taxes were going to 4k. the next sign was home owners insurance was 4k, (starter home insurance 800$). i new something was wrong and then sh-t the fan my husband lost his job. we were able to sell and move. takin our equity and buying newhome 300 miles north where property taxes would not devistate us. we put our 20% down again. the crash 2001 caused everyone we new to lose money in the 401 k plans and we didnt want the money in the bank so we would have easy access. we wanted our equity in our home so when the time came we could take out a home equity loan and help our kids with college. the time is here my 18 yr old son is graduating from high school. he is not going to start at state university 25% student loans are in default. he will stay home and start at community college. so basically the equity that was stolen from us is costing my son his education, why must americans endure this pain of losing our equity and our houses. where is our help why are they punishing us for doing the right thing . it doesnt make sense that if i would have put no money and left my money in the bank i would still have my money today and my house. we need help we need to keep our house or have our equity returned to us.. this is high crimes and needs to be investigated.

There is a solution to this mess . Every individual state should immediately demand that Any and Every Bank prc
ceeding with foreclosure give specific paperwork from all mortgages which shows the chain ot legal ownership from inception of the mortgage to the day the sheriff walks the homeowner out the door. All Lawyers defending the Banks can and will substantiate all documents as being true and free of fraud and so state that they have followed due diligence and the Bank and themselves have all the Certfied Documents needed to proceed with Foreclosure. No Bank, or the Law Firm defending such Bank shall make any assumptions and /or be allowed to make assumptions and they shall be held accountable as well for any Foreclosure that is Granted by any court, anywhere in the “United States of Wallstreet”( formerly the United States of America). All Mortgagee’s Deeds of Trust, trustees, ownership transfers, assigns, be presented to the Courts infatically and precisely free of any fraudulent activity. No foreclosure can proceed until all the documents are in place within any court in the UNITED STATES OF WALLSTREET, A.K.A. the United States of America. Put the Burden of Proof in the laps of the Banks and their Lawyers after admitting already that some of their Mortgages are flawed with problems. At this conjunture every Court can and for that matter should be suspect of any or all other mortgages from any Bank that admits there are even some problems. Even at a Government level, Mers, Fannie Mae, Freddie Mac, yak,yak,yak, are suspect to a possible fraudulent activity. Thousands of True Americans will lose their homes and when,(NOT IF) the truth comes out, the Banks, their Lawyers,Financial Institutions, and yes even our current Justice System will have the destinction of saying, Oh yes I was part of the Scams and Deceit that broke the “American People’s Backs” the biggest scam in History. The Banks, their lawyers and the Judges that preside over these Foreclosure will simply say, “We were just following due process of law”. That will be their lame excuse. But the Banks, Financial Institutions, Title Insurers, any Gov’t agencies dealing or having dealt with any part of these frauds and misleading actions are going down, down , down, which will equal DONE, DONE,DONE! And what if they don’t you may ask? If they don’t their is no GOD, and there is NO JUSTICE! In my opinion the feds already know and see the handwriting on the wall. “When the Bough Breaks the Cradle will Fall” AND IT WILL!!!! Standing in the Forefront like the MONDAY MORNING QUARTERBACKS THEY ARE, will be our allustrious UNITED STATES OF WALLSTREET ( formerly AKA UNITED STATES OF AMERICA) GOV”T. Don’t be surprised when (not if) the shi* hits the fan, they stand there looking like BUTTER WOULD”NT MELT IN THEIR MOUTHS, and say “Those Bastar*s have done this to the American people? We can’t believe this, we’re going to impose heavy fines! We will deposit all currency collected from these frauds and improper actions in our GOV”T bank accounts, make investments in Wall Street and go back to being the United States of America which is a stronger United States of America than it has ever been in the history of this great country! ( The Hell It is).
We are gonna show the American People that Justice will Prevail (the Hell it will), that crime doesnot pay! (the Hell it don’t), and wer’e going to go out and tell each and every American how sorry we are that they were Foreclosed upon illegally. I think we’ll send them a box of Cracker Jacks to assuage their pain. BU———t when I get my box of Cracker Jacks I’ll wager those and include my left NU* that they knew it all along
