GMAC Mortgage may “need to take corrective action in connection with some foreclosures” in the affected states, according to a two-page memo dated Sept. 17 and obtained by Bloomberg News. Ally Financial spokesman James Olecki confirmed the contents of the memo. Brokers were told to stop evictions, cash-for-key transactions and lockouts, regardless of occupant type, with immediate effect, according to the document, addressed to GMAC preferred agents.
The company will also suspend sales of properties on which it has already foreclosed. The letter tells brokers to notify buyers that the company will extend the closing date on all sales by 30 days. Buyers will be able to cancel their agreement to purchase and get their deposit back, according to the letter.

Jeffrey Stephan, who actually works for GMAC Mortgage Corp. in Montgomery County, PA, signs thousands of Mortgage Assignments each month as an officer of other banks and mortgage companies in order to transfer mortgages TO GMAC.
In Florida, the law firms that regularly present documents signed by Jeffrey Stephans as “proof” that GMAC has standing to foreclose include The Law Offices of Marshall Watson, The Law Offices of David Stern and Florida Default Law Group.
Stephan has admitted in depositions that he has no personal knowledge of the facts of documents he signs, does not verify the facts, and often does not sign in front of a notary (though the documents are eventually notarized).

I deal with the selling of a lot of foreclosures and there are many instances where the bank’s attorneys have made mistakes on foreclosures. It is sad to see this level of fraud affecting so many families, not to mention how these foreclosures negatively affect the already fragile real estate market. Now, homeowners who are barely holding on must now deal with their home’s value constantly decreasing.

Well it looks like the BS was spread a bit further… why is Cendant, also a “vehicle” finance company that was shut down due to the CEO going to jail for securities fraud, all of a sudden showing up in recent foreclosures in every state???? They also seem to have a link in SEC filings to USAA Federal, which back’s car finance to veterans… Fishy Indeed! That takes passing the rum jug a at Frat Party 2 new heights!

Really interesting and only wished the internet was around when we had the last recession, as a lot of stories could have been told then … plus maybe more support.
Basically this lists every judicial foreclosure where the fraud can be revealed. Non-judicial foreclosure it seems is game-on because they can still get away with it.
Corrective action?????!!!! Something smells a little fishy. The only true corrective action would be to return the foreclosed properties to the homeowners that were foreclosed upon.
Are they trying to get their ducks in a row – maybe creating more of the fraudulent paperwork?
I am going to reserve the rest of my comments until I see what they are actually doing.
Well, this is one way to start a moratorium!
