Cape Coral – The ACLU Foundation on Thursday will file a Petition for a Writ of Certiorari with the Second District Court of Appeal in Lakeland, Florida, requesting the Court review and rule on the process and procedures used in the “Foreclosure Courts” in the 20th Judicial Circuit of Florida (Charlotte, Collier, Glades, Hendry and Lee Counties).
The Writ alleges serious violations of due process and systemic deficiencies in the “Foreclosure Courts” which result in a loss of protections for homeowners. It requests the Court move the plaintiff’s pending foreclosure action from the “Foreclosure Courts” to regular circuit court proceedings.
The plaintiff in the case is a Cape Coral resident who will be available tomorrow in front of her home at:

how fair was the bank in her dealings with them?
how about the brave elderly neighbor woman who ran out in her pajamas to try to stop this injustice only to be arrested? not to mention the protesters, Take Back the Land. you are heroes!
City Councilman Dana Miller, who lives one street. Good God, man…. do something to help this widow!
i ran after my own Congressional Representative when i saw him on the street headed for my assemblywoman’s office. i told him of the foreclosure fraud perpetrated against my family..
he too, had nothing to say in the way of help. he said ” it is a court matter. go through the courts”
he’s clueless.
i replied that “when it is massive, whole-scale, full-on fraud by the banks…. your constituents need help.”
i am going to vote against this guy next election. i have voted for him 3 times.

Pretty Boy Floyd tore up the unrecorded mortgages in the banks he robbed.
the banks were considered the enemies of widows and orphans.

I still say if the homeowner can prove the ORIGINATION FRAUD AND THE FRAUDULENT INDUCEMENT OF THE MORTGAGE OUR LOANS SHOULD BE AUTOMATICALLY RESCINDED AND RESTITUTION PAID TO THE DEFRAUDED HOMEOWNER FOR BEING DEFRAUDED INTO PAYING A LOAN THAT NEVER EXISTED. AFTER ALL THE ORIGINATION FRAUD IS THE MOTHER THAT GAVE BIRTH TO THE ENTIRE FORECLOSUREGATE SCANDAL AND FANNIE/FREDDIE ARE HIDING BEHIND THE PERPS. RESCIND OUR LOANS!!!!! WE WERE DUPED, DEFRAUDED AND ROBBED, THEY MADE TRILLIONS OFF OF THE CONTINUOUS SALE OF OUR COLLATERAL UP ON WALL STREET AND FORCED THE HOMEOWNERS TO PARTICIPATE IN A PONZI SCHEME THAT THEY HUGELY BENEFITED FROM. NOW THEY WANT TO STEAL THE HOMES OF THE AMERICAN PEOPLE, THAT IS MORE FRAUD, SOON THERE WILL BE ANARCHY IN AMERICA IF THEY DO NOT STOP STEALING THE HOMES OF THE IMPOVERISHED AMERICAN PEOPLE!!! THEY INTENTIONALLY SET US UP TO FAIL, AND DEFRAUDED AND ROBBED HOMEOWNERS ON A MASSIVE SCALE. IF FRAUDCLOSURES ARE NOT STOPPED, SOON THE PEOPLE WILL BE REVOLTING AGAINST THIS PLUTOCRACY. THESE ARE PEOPLES HOMES. WE THE PEOPLE WILL NO LONGER BE — USED AS PAWNS IN THIS ELITE GAME OF MONOPOLY. RESCIND OUR LOANS!!!!!
The problem is not in just those courts, which is what I told the ACLU when I emailed them. I think anyone can find rocket dockets and fraud on the court in any county in this state. For instance, when Matt Taibbi wrote his excellent article about the foreclosure mess here in Florida, he observed the shenanigans going on in a Jacksonville court.
So it isn’t just those five counties who could be deemed the “Foreclosure Courts.” It kind of troubles me that the ACLU has made it seem like it is.
