Foreclosed Home Sold While Owner On Phone With Bank
Man Says Bank Told Him Sale Was On Hold
ARVADA, Colo. — An Arvada man’s foreclosed home was auctioned off, while he was on the phone with the bank.
The sale comes after reassurances that his case was under review.
“It’s not just property to me. It represents my life’s work,” said Ray Vigil, who has owned his home for nearly 14 years.
“I don’t know how soon I’ll be required to move out. But I know I probably better start packing,” said Vigil.
Vigil said he went through tough times but said Bank of America agreed to possibly modify his mortgage. In March a spokesperson sent 7NEWS confirmation that the sale was on hold.
“As long as the modification was under review, that foreclosure sale will not go through,” said Vigil.
On Wednesday afternoon, the home was sold at an auction as Vigil pleaded for help from the bank. He said he was never told that anything had changed.

Due to my husband’s commission flat rate only pay which had dropped less than half and continuing to drop, we had to move to another state where he finally found work. Of course we had to pay rent and we paid all of our bills except the house payment which we never had because there wasn’t enough money. We tried to work with Chase Home Finance but they refused to work with us. At first they wanted a new contract signed for 13 payments a year! Then they wanted all the arrears plus fees. They finally offered to refinance IF OUR HOME APPRAISED (we were supposed to pay for that too) FOR 105% or something like that than the loan. The recession took 25% value of our home away almost overnight AND we hadn’t been in our home very long so had no equity whatsoever. They refused to work with us only to find out after the fact in the State of IL you can hand over the house which we tried 3 times but they refused, if they had agreed there is no recourse for any deficit balance. HA! Exactly! They knew that and that’s why they kept refusing. Then they auctioned the home for 3/4 of the loan. Doubled the balance plus a few thousand more and then billed USDA a year and 1/4 later after the auction. USDA paid it and then sent my husband a bill for 68K. The US Government gave them bailouts. Then they foreclosed on the homeowners. Made money on the auctions. Billed USDA or which Gov agency guaranteed your loan for whatever they trumped the bill up to. The federal gov agency comes after the exhomeowner for all that money. So now you get to rent for the rest of your life and pay for a home you don’t own plus have no credit so will probably have trouble renting and finding employment. Moral of this story: CHASE MADE 105K HOME LOAN, 2 YRS LATER THE HOME WAS AUCTIONED, THEY BILLED USDA WHO PD, ADD THE PYMTS WE MADE FOR A YR = CHASE MADE ABOUT 50K PROFIT over the loan amount for a home we lived in for 1 year! We owe 68K after all the pymts etc for a home we lived in for 1 year! The Gov is in bed with the corporates. I have been fighting for my home since January 2008.The lawyer represented both buyer and seller,and notarized documents as well.He never told me there were back taxes added to my mortgage,until I received the bill from the County.I went to the County to make arrangement to pay the back taxes,but they wouldn’t accept my money because I had no proof the home was mine.The deed wasn’t filed until nine months after I signed the mortgage papers.I have been trying to figure out who holds the mortgage on my home ever since.I’ve spent numerous amounts of time and money trying to resolve this,but nobody wants to help.I have been to foreclosure hearings in court,and still nobody wants to hear the truth.They are only focused on the foreclosure.I do not know who to pay,First Franklin,Lasalle Bank,Home Loan Services,Bank of America,or Merril Lynch.Here is the good part! I have been mortgage free for over 3 years now,and haven’t paid a dime to any of these thieves.The Court wants my legal aid advisor and I to submit another modification application and try to work things out.My next hearing is May 25th in Cortland,N.Y.I asked my appointed Attorney if we can sue everyone,but she said she can only focus on the foreclosure.She knows everything that’s happened,and still ignores the fraud that has taken place.I am ready to go to the media with this,and stand up for the hard working people of America.I need someone to hear my story,and help me take this to court.I have complaints and cases established with the Attorney General,office of the Comptroller of Currency,and office of Thrift Supervision.Please let me know what I can do to take legal action in this situation.Nobody here in upstate,N.Y. wants to listen or help.I need a good Lawyer to help me,any suggestions or referrals?Thank you.
good luck. they won’t modify unless they can cheat you. media won’t help, those are their advertisers, AG is clearly on the take. i do not ‘get’ why lawyers do not ‘get’ it..Good luck. maybe we need to post court dates and times,,,can we get witnesses, lots of them? God be with you all

How much longer will you beleive these are conventional foreclosures. This is a mass recovery of a UCC filed against a banks outstanding debt and stock transferrs , written down and credited to the government. It is capitation and restoring value to worthless securites using real porperty. It’s is a pro tanto forefieture simialr to emeinant domain.

OK, i had about enough of this crap day after day. where is obama , oh he must be hiding in the hills with OSama??? all joking aside america is in trouble. every email i have opened is about couples, men , women, our childrem being foreclosed on homes we can not sell. mortgages given to us we could not afford , or mortgage modification fraud. where is our president. where is he. where is a news conference from the oval office. where is our president saying ” FRAUD HAS BEEN PERPERTRATED ON THE AMERICAN PEOPLE AND IS DEVISTATING FAMILIES. i AM GOING TO WORK DILIGENTLY WITH CONGRESS TO RESTORE AMERICA TO THE GRANDOUR IT ONCE HAD.
