THIRTY-TWO PLAINTIFFS FILE RICO ACTION AGAINST JPMORGAN CHASE BANK AND CHASE HOME FINANCE
Thirty-two Plaintiffs have filed a multi-count Complaint in the Circuit Court for Palm Beach County, Florida against JPMorgan Chase Bank and Chase Home Finance, LLC. The Plaintiffs retained Jeff Barnes, Esq., whose Firm, W. J. Barnes, P.A., filed the action last Friday.
The 29-page Complaint alleges several causes of action including violations of the Florida RICO Act, and requests temporary and permanent injunctive relief on a national level to halt all Chase-related foreclosure activity in the eight (8) separate states in which the Plaintiffs reside. The Complaint alleges a pattern of criminal activity on the part of JPMorgan Chase Bank and Chase Home Finance in connection with the institution of both judicial and non-judicial foreclosures, including but not limited to the filing and recording, in the public records, of forged and fraudulent documents; fraudulent collection activities; intentional misuse of the MERS system; and the intentional misrepresentation, in foreclosures across the United States, that Chase is the “successor in interest” to Washington Mutual Bank when in fact Chase itself has affirmatively represented, in multiple Federal court filings in different states, that it is NOT the successor in interest to WaMu, and only purchased certain defined assets and liabilities from the FDIC as Receiver for WaMu.

Henry – did you get an answer to your question? I checked the PB county Clerk of Court records and I could not find it. I, also, would like to know that information especially since it was supposedly filed in August of 2011….pass it on if you got the info….
i HAVE THE EXACT case Chase claiming to have standing and Deutsche Bank filing for Chase Bank. I am also a victim of Chase Bank modification serving fraud. Chase Home Servicing told me to fall behind on three different occasions by three different servicer employees, before I decided it is the bank, they must know what they are doing. I was told I would have to inorder to qualify for the mod. Then I paid five mod payments once I was approved by phone. Told to begin immediately and not to wait for the mod payment coupon s, which did come eventually. Then after five payments I was told due to the O’bama changes I was now unapproved and my mod payments were considered partial payments and I was in foreclosure unless I came up with over twentyfive thousand or the full principal and fees.

With the US Government aiding and abetting the banks, it appears that the RICO “private district attorney” statute is the last refuge for change. There needs to be a large NATIONAL RICO lawsuit brought. That same suit needs to name the State and Federal agencies involved, as co-conspirators in a continuing financial crimes enterprise. When the US and the states are put on their heels having to defend themselves against civilly prosecuted criminal acts, the game WILL change.
We need to get a lawyer to take on a national RICO case against the banks and the governments. It is perfectly legal. The Tucker Act is another useful tool against the government. Their interference in your private contract, holds them accountable, and they cannot claim sovereign immunity.
If there is an AG settlement, all 50 state AGs should also be named. If successful, they could be removed from office for “disability”. We need to use the laws to fight bank. Not the “wrongful foreclosure” and “fraud” laws. The bigger guns are needed at this point. RICO, The USA Patriot Act anti-money laundering provisions, The Tucker Act, and Anti-trust laws are some of the examples.
The federal courts need to be clogged with these cases, as the states are failing miserably, and the SCOTUS needs to get involved.
Tim….Here in Florida….I believe Ice Legal would be the law firm I would suggest…although I only know of them…and I have always heard remarks of high respect….I believe the Law Firm is quite large…What I do not know is if this law firm will do this type of lawsuite…but it is a suggestion and may be worth a try…..Maybe someone in another state knows of a law firm to suggest….I just feel comfortable with my suggestion of ” ICE LEGAL “…….or maybe Ice Legal can guide us in the right direction of others who may be of help…in state or out state…..if we don’t start to do something…soon…it will be to late…..

We live outside of Pensacola, Fl and had a phone consultation with Ice Legal. The only problem for us is their location and cost to represent us in Northwest Florida. Does anyone know of a good foreclosure defense attorney in the Northwest Florida region. There is not much help for us here. We have been fighting Citimortgage since April 2005. Foreclosure was vacated March 2011. But we know they are up to something. It is sad when we are educating attorneys and realtors to what has been happening in all 50 states. Ready to put this past us and start living again with a new mortgage contract at 4% interest or less. We have been paying 11% interest that accures daily. No way to get a head and pay our house off that we only owe $62,000.00 and have been living in our home for 17 years. Our country is in a sad shape with greed ozzzing out of every orfice.
A nationwide RICO lawsuit will draw all this to a head. I would especially like to see Tim Geithner and Eric Holder named as co-conspirators. Geithner testified to Congress that he never intended to enforce the provisions of TARP that held banks accountable. Eric Holder has been committing misprision since this began. I would love to see them explain, under oath, their actions. Along with Tom Miller, and the other AGs (assuming they settle). They are intentionally, and tortionally, running interference for the banks, involving private contracts. They have no authority for any national settlement (1st amendment, section 10).
The government is so out of line in order to protect the banks, they have violated the constitution, and criminal law (especially MISPRISION). The DOJ has their thumbs up their butts, so RICO is the last alternative in a corrupt nation.
Imanda…I would file a counterclaim and sue the pants off of your pretender lender for fraud….I have an attorney affiliated with Ice Legal…..He told me and my husband that we can sue the pretender lender for 2-3 the value of our home and make them pay for our legal fees…..
Rob, the fraudclosure firm attorneys are not well equiped for battle either from what I have been told…..They are freshies out of law school, my attorneys call them silk stocking law firms…My attorney’s strategy is a good one…to force the banksters to have to hire the more expensive law firms to handle their case….the $900.00 DOLLAR and hour ones…..and also countersue the pretender lender for all of their fraud….2-3 times the value of our homes, businesses…plus our attorneys fees…

He chose the worst venue because he is the worst attorney to handle the case! He obviously doesn’t know what he is doing. These people should have done more research on him before they retained him.
