Judicial Proceedings: Designates act “Florida Fair Foreclosure Act”; revises requirements for acknowledgement of satisfaction of mortgage, lien, or judgment; provides requirements for mortgage foreclosure complaints; requires party foreclosing on specified owner-occupied dwellings to provide specified notice; provides for finality of foreclosure; requires certain actions to set aside foreclosure to be treated as actions for money damages; provides requirements for preparation and recording of instrument acknowledging satisfaction; prohibits certain claims following foreclosure based on enforcement of lost, destroyed, or stolen note; provides requirements for deficiency decrees in foreclosures of certain occupied units; revises procedural provisions relating to foreclosure proceedings; provides for determination of reasonable attorney fees for foreclosing certain owner-occupied properties; provides for election by foreclosing lender to proceed without public sale in certain circumstances; provides for liability of persons wrongly claiming under lost, stolen, or destroyed notes; provides for sanctions for raising unsupported claims or defenses & delay of litigation.

Hi all, tomorrow (Wednesday Jan 25th) the civil justice committee in the legislature will be voting and discussing HB 213–please call and oppose any bill for the non-judicial effort–
possible script–
I oppose HB 213 & THE AMENDED PCB WHICH WOULD ENCOURAGE THE CONTINUATION OF ILLEGAL FORECLOSURES AND MAKE Florida A NON-JUDICIAL STATE. I want our legislature to SUPPORT homeowners by supporting HB 145 introduced by Darren Soto. This bill encourages truthfulness in our courts and a penalty for putting fraud in the court.

House of Representatives Staff Analysis
Following a CS (Committee Substitute) the CS-Bill goes back to the Speaker for committee reassignment. This is why is bypassed Insurance & Banking totally.
Keep calling. Make appointments.
Committee is in session until 10:30am CALLS ARE STILL IMPORTANT THIS MORNING.
we can move on to the other committees this afternoon.
I first alerted about this, but unfortunately the vote is 8 am tomorrow (1.25.12). Due to physical limitations I can not appear. I expect it to pass. Especially a shame because the legislative economist Aimee Baker, who provided statistics used LPS analytics. Except for Rep. Soto I doubt members understand the ramifications of that!
If you look at the video archives from the subcommittee and listen to the discussions, it appears that members think Robosigning was merely a necessity to correct clerical errors, not to unbifurcate the note and mortgage.
It will most certainly pass the Insurance and Banking Committee.
So, we must start now to contact the members of the other two committees it must go through.
Justice Appropriations Subcommittee and Judiciary Committee. If we hit them hard with the facts and DO put in appearances, perhaps we will prevail.
