The hearing will start at 10:30 am and at that time the Media Portal page will have a link to watch the Judiciary Hearing live from your computer. They could choose to take up this bill, but also could not- it is on agenda, but that does not always mean they will hear that day. Sometimes they bump it to another day’s agenda depending on what they feel like doing. Mortgage Foreclosure Proceedings; Citing this act as the “Florida Fair Foreclosure Act”; specifying the limitation period for initiating an action to collect a deficiency following the foreclosure of certain dwellings; requiring certain individuals to execute instruments acknowledging the satisfaction of liens and judgments and to provide a certified copy of the recorded satisfaction to the person who made the full payment; requiring a foreclosing party in certain mortgage foreclosure actions to provide notice to the mortgagors and tenants relating to their rights and obligations, etc.

I missed the very beginning when they spoke about portions redacted, but listened to and recorded the entire hearing. There is a new bill version dated 02/17/2012 at 4:38 PM; the .pdf is here: http://www.flsenate.gov/Session/Bill/2012/1890/Amendment/696168/PDF The most notable change was limitation of time to bring a deficiency judgment from two years to one year. Wow, we have them over a barrel now…
I was disgusted by the strategy to shift this bill away from its true intent (clearing of title, limited recourse after final judgment, and speeding all foreclosure procedures) to “this is a bill to rid our cities of abandoned properties…” We have and always will have abandoned properties; places where illegal activities occur and/or offer succor. Where have these legislators been for the past 50 years?
I was also nauseated at their insistence passage of this legislation will create a mecca of business activity, tourism, and economic prosperity for all. One senator said we need to start building more houses again!? And to ensure the last “public” comment came from a person representing the banking industry was appalling.
This is one big sweeping under the carpet (aiding and abetting) of what was/is the destruction of property rights and massive transfer of wealth.
I only heard one “NO” vote.

Well, it passed but with a lot of redacted…..could not clearly understand all the changes Grateful for those who stood up and spoke FOR the people and AGAINST those who seek to undermine the basic Rules of Procedure and our constitutional rights! Remember and note those who are destroying our land rights……remember their names when election time rolls around!!!!!!
